2. The petitioner seeks regular bail in the present case registered for the offences punishable under Sections 103(1), 61(2), 352 and 3(5) of the B.N.S.
3. As per the prosecution case, unknown persons killed the informant's husband.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is next submitted that though some persons are named in the FIR as assailants of the deceased, but the petitioner is not named in the FIR. Learned counsel further submits that petitioner has two criminal antecedents and he is in custody since 21.02.2026. The petitioner undertakes to co-operate in the
Patna High Court CR. MISC. No.40623 of 2026(2) dt.24-06-2026 2/2 case/ trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner and submitted that during investigation, it has come that the criminals who had shot and killed the deceased had stayed in the house of the petitioner.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna /concerned Court below in connection with Gopalpur P.S. Case No. 99 of 2026.
