The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 379, 420, 411, 34 of the Indian Penal Code and Section 4 and 40 of the Bihar Minor Mineral Concession Rule and Section 15 of the Environment Protection Act.
Prosecution case in short is that one truck bearing no. UP65GT-5070 and tractor bearing no. 927013185333 were found overloaded with sand, for which no paper was produced in support of the same.
Learned counsel for the petitioner submits that the petitioner is the owner of the vehicle and he is not concerned with the aforesaid seizure. The petitioner has no criminal

Considering the facts of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Barun P.S. No. 60 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
