JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case which was initially, registered under Sections-447, 341, 323, 308, 379, 506/34 of the Indian Penal Code, but later on, Section-307 of the Indian Penal Code was also added.

Petitioner and co-accused Amar Kumar Singh are said to have assaulted the informant by iron rod, causing injury on his head but in course of investigation, the informant claimed that it was the petitioner, who gave iron rod blow causing head injury to him. The injury report of the informant goes to show that one fracture injury was found on his head. There is nothing in the written report as well as statement of the informant to show that

The petitioner is languishing in jail custody since 08-05-2016 and the investigation against the petitioner has already been completed. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sanhaula P.S. Case No. 27 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-V, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
