Petitioner seeks regular bail in connection with Chhatapur PS Case No. 232 of 2019 registered under Section 341 , 323, 325, 307, 379, 376(D), 506 /34 of the IPC. As per the first information report petitioner along with other accused persons committed rape upon the informant and assaulted other family members, who were accompanying informant on the date and time of occurrence. Learned counsel for the petitioner submits that petitioner has falsely been implicated due to the fact that there was some dispute with regard to running eatery shop by the informant's brother-in-law and the petitioner. He further submits that from perusal of the FIR it would be evident that informant has stated that at the time of committing offence the petitioner and others assaulted the mother-in-law of the informant and her

No.49920 of 2021(3) dt.28-04-2022 2/2 husband due to which the hands of her husband was fractured and tooth of the mother-in-law was broken but during the course of investigation injuries sustained by the mother-in-law and the husband of the informant have not been found. He further submits that petitioner is in custody since 30-12-2020, charge sheet has already been submitted and the co-accused / Pappu Kumar Ram @ Pappu Ram has been granted bail by a Bench of this Court in Cr. Misc. No. 80776 / 2019.

Regard being had to the submissions made by the parties and taking into consideration the material available on record, the fact that petitioner is in custody since 30-12-2020, charge sheet has already been submitted and co-accused has been granted bail by a Co-ordinate Bench of this Court, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Supaul in connection with Chhatapur PS Case No. 232 of 2019.
