1. Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner apprehends his arrest in connection with Mahindbara P.S. Case No. 07 of 2023 registered under Sections 420, 467, 468, 471, 120B, 34 of the Indian Penal Code and Sections 30(a), 32(ii) (iii), 36 and 41 (i) (ii) of the Bihar Excise Act.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to local politics. Further submission is that similarly situated co-accused has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 22.05.2023 passed in Cr. Misc. No. 24847 of 2023, as contained in Annexure-2 to the bail application.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Judge-I, Sitamarhi in connection with Mahindbara P.S. Case No. 07 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
