JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-03-2022 Heard Mr. Ranjeet Kumar Mishra, learned counsel for the petitioner and Mr. Khurshid Anwar, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Riga PS Case No. 122/2019 registered for the offence punishable under Sections 272/273/414 of the IPC and Section 30(a) of Bihar Prohibition & Excise Act.
As per First Information Report, 150 litres of illegal Nepali Saunfi/liquor has been recovered from Maruti Car and the allegation is that the petitioner was acting as liner in the transportation of the illicit liquor.
Learned counsel for the petitioner submits that on merit anticipatory bail application of the petitioner was allowed by the Co-ordinate Bench of this Court in Cr. Misc. No. 651/2020 (Annexure-2) and due to the fact that the petitioner

No.49999 of 2021(2) dt.25-03-2022 2/2 could not surrender within the time frame fixed by the court and could not furnish the bail bond, the petitioner was arrested by the police on 20.06.2021 and since then he is in custody. Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that anticipatory bail application of the petitioner was allowed on merit, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, ANAND KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IIcum-Special Judge, (Excise), Sitamarhi in connection with Riga PS Case No. 122/2019.
