Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is accusation against the petitioner that he caught hold of the informant with bad intention and also made attempt to commit rape on her. Furthermore, petitioner threatened the informant to throw acid on her face. The aforesaid fact was supported by the informant in her statement recorded under section 164 of the Cr.P.C but learned counsel for the petitioner submits that when the informant was examined in course of trial, she gave a different statement. It is further submitted that, as a
Patna High Court Cr.Misc. No.30038 of 2016 (2) dt.04-08-2016 2/2 matter of fact, petitioner is next door neighbour of the informant and there was dispute between the family of the parties on the point of throwing garbage and that is the reason of false implication of the petitioner in this case.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st- cum Special Judge, Bettiah, West Champaran in connection with Bettiah Town ( Kalibag O.P) P.S.Case No. 67 of 2016.
