The petitioner seeks bail in Ganga Bridge P.S. Case No. 03/2017, registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
The petitioner was arrested while fleeing away from his hut and from the hut 308 litres of Indian made foreign liquor of different brands was recovered.
Learned counsel for the petitioner submits that the hut is in the name of grand-father of the petitioner. There are so many persons in the family and it could not be said that the petitioner had kept the foreign liquor in the hut. The petitioner remained in jail for more than two months.
Patna High Court Cr.Misc. No.12446 of 2017 (2) dt.22-03-2017 Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Hajipur, Vaishali in connection with Ganga Bridge P.S. Case No. 03/2017.
