Writ application is for a direction upon the respondents to appoint the petitioner on the post of a constable because he is a successful candidate.
Respondents were directed to file counter affidavit and explain the reason for non-appointment of the petitioner. They have filed a detailed counter affidavit but the crux of the issue is crystallized in para 11 and in support thereof they have annexed Annexure-D, which is the application form of the petitioner. In view of the same, the stand of the respondents is that it is

Petitioner does not belong to Gorkha Non-Homeguard category. Obviously, petitioner did not make declaration or fill up the form properly.
In view of the above, no relief in favour of the petitioner can be granted.
Writ application is dismissed.
