JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Ghoghardiha P.S. Case No. 15 of 2015 registered for the offence under Sections-341, 323, 379, 504/34 of the Indian Penal Code as also u/S 3(i)(x) SC/ST )Prevention of Atrocities) Act. According to prosecution case, the informant was made confined in the house of the petitioners and his caste name was uttered by the petitioners inside the house. So far as allegation of snatching of money is concerned; the contention on behalf of the petitioners is that the aforesaid allegation has been levelled with a view to make the offence graver.

No.22888 of 2015 (2) dt.09-07-2015 2/2 Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Ghoghardiha P.S. Case No. 15 of 2015 to the satisfaction of Learned Sub Divisional Judicial Magistrate, Jhanjharpur, Madhubani subject to conditions as laid down u/S 438(2) of the Cr. P.C.
