The petitioner seeks bail in S.Tr. No. 441/2016, arising out of Dulhin Bazar P.S. Case No. 22 of 2016 registered under Sections 341, 324, 326, 307/34 of the Indian Penal Code. The petitioner is alleged to have caused injury on neck and tongue of Pappu Mahto. Learned counsel for the petitioner submits that from perusal of Annexure-2 it would appear that lacerated wound was found on neck and tongue of Pappu Mahto.

The injury is serious or grievous. On the last date, the learned A.P.P. was directed to get the injury report but even till date the injury report has not been sent to this Court. The learned A.P.P. again prayed for time to get the injury report. The petitioner is in jail since 17.02.2016.

No.37653 of 2016 (4) dt.25-11-2016 2/2 It is a sorry state of affairs prevailing in the Police Department that such a police officer is vested with the power of investigation who does not know how to investigate the case. Without obtaining the injury report the investigating officer has submitted chargesheet. Even after repeated adjournments, the learned A.P.P. has not been able to get the injury report. Considering the facts aforesaid and the fact that the petitioner is in jail since 17.02.2016, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV, Danapur, District Patna in S. Tr. No. 441 of 2016 arising out of Dulhin Bazar P.S. Case No. 22 of 2016.

Let a copy of this order be sent to the Senior Superintendent of Police, Patna for information and needful. (Prabhat Kumar Jha, J) Dilip/- U T
