1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 27.02.2024 and has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is further submitted that no doubt, petitioner is alleged to have assaulted the informant by khanti causing injury on head, but then, the injury suffered by the informant is simple in nature and the blow was not repeated, which amply demonstrates that petitioner never had any intention of committing a serious
Patna High Court CR. MISC. No.42170 of 2024(2) dt.21-09-2024 2/2 occurrence. It is also submitted that charge-sheet has been submitted and petitioner is not a criminal.
4. Learned A.P.P. opposes the bail application.
5. Considering the submissions made by the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur in connection with Chakmehsi P. S. Case No.155 of 2023.
6. The application stands allowed.
