2. The petitioner seeks regular bail in connection with Dhanarua P.S. Case No. 504 of 2024 registered for the offence under Sections 80(2), 238(b) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The petitioner is the husband of the deceased. The marriage was solemnized six years ago. The petitioner is accused of killing the deceased.

4. The following statement has been made in paragraph no. 15 of the bail petition:

"15. That the minor children of the petitioner are residing in the house of the petitioner. They are roaming in the village as they are not going to their school due to the petitioner being in the Jail. Their life is also being ruined."

5. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 15.01.2025.

6. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Masaurhi/concerned Court below in connection with Danarua P.S. Case No. 504 of 2024 subject to condition that:- (i). At the time of accepting the bail bonds of the petitioner, the Court below will verify the statement made by the petitioner that the minor children are residing in the house of the petitioner. If the statement is found true then only the bail bonds of the petitioner shall be accepted otherwise the bail bonds shall not be accepted.
