JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 115/34 of the Indian Penal Code and Section 25(1-b)/26/35 of the Arms Act. Five persons including the petitioner are said to have been caught, while they were making plan to commit murder of the deceased and one mobile phone as well as one live cartridge are said to have been recovered from the conscious possession of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.28731 of 2016 (2) dt.25-07-2016 2/2 two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 17 of 2016.
