The petitioner seeks bail in Gaya Rail P.S. Case No. 301 of 2016 registered under Section 30(a) of the Bihar Excise Amendment Act, 2016.

The petitioner and Butti Prasad along with Sarjun were apprehended and from the possession of the petitioner and Butti Prasad, many bottles containing Indian made foreign liquor of Imperial Blue, Whiskey, Royal Stag, etc. were recovered. It is submitted that the petitioner was apprehended on 18.10.2016 and since then he is in jail. Co-accused Butti Prasad has already been enlarged on bail vide order passed in Cr. Misc. No. 9582 of 2017.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.14105 of 2017 (2) dt.13-04-2017 2/2 petitioner is also directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Gaya in connection with Gaya Rail P.S. Case No. 301 of 2016.
