Petitioners being sister-in-law(gotani) and mother-in-law of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
The accusation is killing the daughter of the informant after two years of marriage.
It is submitted by learned counsel for the petitioners that accusation is not specific and husband of the victim has been acquitted vide judgment and order dated 30.03.2015 passed by learned Additional Sessions Judge, 1st, Saharsa in Sessions Trial No. 2430 of 2014. The certified copy of the same has been produced. Let it be kept on record. It is further submitted that investigation against the petitioners is
Patna High Court Cr.Misc. No.23072 of 2015 (2) dt.13-07-2015 2/2 still pending.
Considering the fact that husband of the victim has been acquitted and the accusation against the petitioners being omnibus and general, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 297 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
