05.08.2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case registered for the offences under Sections 341, 323, 448 and 354(B) of the Indian Penal Code.
The accusation against the petitioner is that in the midnight of 27.05.2016 the petitioner forcibly entered into the house of the Informant to attempt to outrage her modesty but on hue and cry of the Informant, her fatherin-law came there and caught the petitioner.
Subsequently, the Police was informed and petitioner was arrested.
Submission on behalf of the petitioner is that no such occurrence as alleged in the written report has
Patna High Court Cr.Misc. No.30589 of 2016 (2) dt.05-08-2016 taken place and the petitioner has been implicated in this case with an ulterior motive. He has further submitted that petitioner is in jail custody since 28.05.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the Petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 180 of 2016.
