The petitioner seeks regular bail in connection with Bairgania P.S. Case No. 36 of 2023, registered for the offences punishable under Sections 25 (1-b)a and 26 of the Arms Act. As per the prosecution case, the petitioner was arrested with a country-made pistol.

Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. The alleged recovered pistol, as per the report, is not in workable condition. Charge-sheet has already been filed and there is no chance of absconding of the petitioner or tampering with the evidence. Petitioner has no criminal antecedent and is in jail custody since 08.02.2023.

Patna High Court CR. MISC. No.41064 of 2023(2) dt.14-07-2023 2/2 Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 36 of 2023.
