JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was rejected by this Court taking note of this fact that petitioner was absconder and even after an attachment of his property, he could not be apprehended. The trial court has reported that the charge against the petitioner was framed on 30.05.2016 and to ensure the presence of prosecution witnesses non-bailable warrant of arrest has already been issued against them.

Considering the previous conduct of the petitioner as well as facts and circumstances of the case, again I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Session trial no. 134(A) of 1996 arising

Patna High Court Cr.Misc. No.16891 of 2018 (4) dt.02-05-2018 2/2 out of Danapur ( Shahpur) P.S.Case No. 252 of 1993, pending in the court of Additional Sessions Judge- VI, Danapur stands rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
