By order dated 25.04.2022, the petitioner was granted bail. Based on the pleadings made in the bail application, the police station was recorded as Madhepura when the police station of the present case is Singheshwar, this fact came to the notice of the Court before signing the order dated 25.04.2022 as such the case today has been kept under the heading 'To Be Mentioned'.
Learned counsel for the petitioner is permitted to make rectification in the pleadings in the bail application and the police station which is mentioned has Madhepura in the bail application be rectified to be read as Singheshwar. The petitioner seeks bail in a case registered for the
Patna High Court CR. MISC. No.49860 of 2021(3) dt.27-04-2022 2/3 offences punishable under Sections 302, 328 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.06.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that the named accused persons, including the petitioner, killed his sister by poisoning.
Learned counsel for the petitioner submits that one Suresh was married to Ranju and the deceased was own sister of Ranju Devi and this petitioner is neither related to Suresh or his family members in any manner as such there was no occasion for this petitioner to kill the deceased. It is further submitted that the allegations are general and omnibus in nature and is based on suspicion as the informant is not an eyewitness to the occurrence.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 24.06.2021, is a person with clean antecedent, chargesheet has been submitted in the case, and is in no way related to Suresh or his family members, as aforesaid, let the petitioner
Patna High Court CR. MISC. No.49860 of 2021(3) dt.27-04-2022 3/3 above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Singheshwar P.S. Case No. 253 of 2020.
