The petitioner is languishing in custody in connection with Supaul P.S. Case No. 61 of 2016 for the offence instituted under Section 392 of the Indian Penal Code.
The prosecution story, in brief, is that three unknown miscreants looted cash of Rs. 9000/-, ATM Card, Passbook, Driving License and one Samsung mobile from the informant and fled away.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.03.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.29507 of 2016 (3) dt.05-09-2016 2/2 petitioner is not named in the First Information Report and his name has come on the confessional statement of co-accused. It is further submitted that the petitioner has not been put on Test Identification Parade. The recovered article from the possession of the petitioner has also not been put on Test Identification Parade. On behalf of the State, it has been submitted that the petitioner is not named in the First Information Report. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 61 of 2016.
