JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-05-2017 The petitioner seeks regular bail in connection with Phulwarisharif P.S. Case No. 128 of 2017, registered for offences punishable under section 30(A) of Bihar Liquor Prohibition & Excise Act.

The allegation against the petitioner is of recovery of 10 litres of country-made mahua liquor from her house. It has been submitted on behalf of the petitioner that she has no criminal antecedent and has falsely been implicated in this case and has remained in custody for more than two months. Further, she is a lady.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts that petitioner is a lady and has no criminal antecedent, let the

Patna High Court Cr.Misc. No.21592 of 2017 (3) dt.12-05-2017 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna, in connection with Phulwarisharif P.S. Case No. 128 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without obtaining prior permission from the court concerned, the prosecution is free to move for cancellation of her bail.
