1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 188,
Patna High Court CR. MISC. No.42532 of 2023(2) dt.09-08-2023 2/3 342, 143, 353 of the Indian Penal Code.
3. The informant alleges that when model code of conduct was implemented for Nagar Palika election in 2022 when the accused persons including the petitioners along with 100 unknown persons obstructed traffic and blocked the road without taking permission from the local administration.
4. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent.
5. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that the date of occurrence is 19.09.2022 and the FIR came to be instituted on 27.09.2022 and there is no specific allegation of committing any overt act by the petitioners.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
7. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is
