JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 366 and 366A of the Indian Penal Code. Allegation against the petitioner is that she took the daughter of the informant along with her but thereafter she (victim) did not return. It is further alleged that her daughter was taken away for the purpose of marriage or rape. It has been submitted on behalf of the petitioner that she has got no criminal antecedent. From perusal of the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, it appears that she left her house on her own will and had married Pavitra Yadav @ Chhotu. So far as petitioner is concerned, no allegation has been made against her and she is a lady.
On behalf of the State, it is submitted that petitioner has not been made accused in the F.I.R.
Considering the aforesaid facts, let the above named petitioner, in the event of arrest or surrender in the court below
Patna High Court Cr.Misc. No.23219 of 2015 (4) dt.21-09-2015 2 / 2 within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S.
