JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 354, 379 and 504 of the Indian Penal Code.
It is alleged that the accused persons assaulted and outraged the modesty of the informant when petitioner Santosh Ojha snatched the bag of the informant containing `2,000/- and other articles.
It is submitted by learned counsel for the petitioners that petitioners' side lodged Gopalgaj P.S. Case No. 140 of 2014 on 29.03.2014 levelling accusation under Sections 341, 323, 379 and 504 of the IPC against the informant of the present case thereafter
Patna High Court Cr.Misc. No.22663 of 2015 (2) dt.24-06-2015 2/2 the present case has been lodged on 07.04.2014 for the occurrence of 28.03.2014. It is further submitted that the petitioners were earlier tenant of the informant and there was some dispute, hence the present case has been lodged as retaliatory measure. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Gopalganj in connection with Gopalganj P.S. Case No. 280 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
