Patna High Court CWJC No.1923 of 2021(2) dt.29-07-2022 2/2 ORAL ORDER 29-07-2022 Though the present writ petition has been filed for removal of encroachment made over the public land, however, it is submitted that the Circle Officer, Majhauliya, Distirct-West Champaran has already initiated Encroachment case No. 14 of 2018-19 but the same is not proceeding and has not been taken to its logical conclusion, hence direction be issued to the respondent no. 5 to pass the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956.
Accordingly, the present writ petition stands disposed off with a direction to the Circle Officer, Majhauliya, DistrictWest Champaran to dispose off the aforesaid Encroachment Case No. 14 of 2018-19 within a period of 12 weeks of receipt/production of a copy of this order by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 and in case encroachment is found, the same is also directed to be removed within the same time frame.
