2. The petitioner seeks regular bail in connection with Naubatpur P.S. Case No. 568 of 2019 corresponding to S.Tr. No. 74 of 2022 registered for the offence punishable under Section302 of the Indian Penal Code.

3. The informant, Rakesh Kumar is son of the deceased, Binda Manjhi. He mentioned in the FIR that some altercation had taken place between the deceased and the petitioner. It is further alleged that in the night, the informant saw the petitioner fleeing away from the room of his father. He (the informant) went inside the room and found his father in injured condition. His father had suffered injuries on his

4. Learned counsel for the petitioner has submitted that the informant has been examined as P.W. 1. His deposition is entirely different from his earlier version. In his deposition, he does not claim himself to be an eye witness of the occurrence. The petitioner is under custody since 30-08-2019.

5. Learned counsel appearing for the State has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.-V, Danapur, Patna in connection with Naubatpur P.S. Case No. 568 of 2019 corresponding to S.Tr. No. 74 of 2022 subject to the condition that the petitioner will cooperate in trial and shall make himself available as and when required by the court.
