JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code.

The accusation against the petitioner is that one Mukunder Kumar appeared in the examination in place of petitioner but having similar allegation, some co-accused have already been granted privilege of bail. Petitioner does not have any criminal antecedent and is languishing in jail custody since 15.05.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.31565 of 2016 (2) dt.12-08-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Jogbani (Bathnaha) P.S. Case No. 65 of 2016.
