JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioners seek regular bail in connection with Gayghat P.S. Case No. 163 of 2016, registered for offences punishable under Section 392 of the Indian Penal Code. It has been submitted on behalf of the petitioners that petitioners were initially arrested in a case of Arms Act and thereafter they have been remanded in three other cases including present one only on the basis of confessional statement of coaccused. petitioners have been languishing in custody since 23.11.2016.

Having heard both sides, in view of the fact that petitioners' name transpired on this case only on the basis of confessional statement of co-accused and except that there is nothing against the petitioners, let the petitioners above named, be
Patna High Court Cr.Misc. No.10240 of 2017 (2) dt.06-03-2017 2/2 released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Muzaffarpur in connection with Gayghat P.S. Case No. 163 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
