JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-07-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor as well as learned counsel for the informant.
Both the petitioners are father in-law as well as mother in-law. There happens to be specific disclosure in the written report with regard to conduct of husband of deceased, who had subjected the deceased with torture at every occasion. Furthermore, the subsequent allegation regarding accused six in number, have been made in omnibus nature and further suggesting that they have committed the murder of the deceased. It has been submitted on behalf of petitioners that husband of the deceased had already surrendered and been declared Juvenile. From further
Patna High Court Cr.Misc. No.25438 of 2016 (04) dt.13-07-2016 statement of the informant recorded under Para-2, had reiterated the same. The other witnesses so examined under Paras-23, 24, 25 of the case diary have not alleged any specific instance against the petitioners, more particularly, even on the alleged date of occurrence.
Accordingly, petitioners, Pradeep Nat and Meena Devi are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chandi P. S. Case no.13 of 2016.
