JUSTICE ARUN KUMAR ORAL ORDER 20-04-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Sangrampur P.S.Case No. 171 of 2017 registered under Section 302 of the Indian penal Code. Allegation in brief is that while the informant's brother was coming on motorcycle then accident was caused by his motorcycle to Nand Kumar thereafter these petitioners along with others assaulted him causing his death.
Learned counsel for the petitioners seeks bail of the petitioners on the ground of parity as another similarly situated co-accused Prabhu Sah has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 9916 of 2018. Having considered the aforesaid facts and circumstances as the petitioners are also stand on similar footing to Prabhu
Patna High Court Cr.Misc. No.10981 of 2018(4) dt.20-04-2018 2/2 Sah, the petitioners, namely , Binod Kumar Sah and Bittu Kumar Sah, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ACJM 14, Motihari, East Champaran in connection with Sangrampur P.S. Case No. 171 of 2017.
