The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Submission is that the petitioner has been falsely implicated in this case due to dirty village politics. Nothing has been recovered from the conscious possession of the petitioner and has a clean antecedent. It is submitted that the place from where the alleged recovery of illicit liquor has been made does not belong to the petitioner. It is further submitted that similarly situated co-accused have already been granted the privilege of bail by co-ordinate Benches of this Court in Cr. Misc. No. 39587 of 2018 on 12.07.2018 and Cr. Misc. No. 24640 of 2019

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge (Excise), Buxar in connection with Koransarai Police Station Case No. 02 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
