JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-03-2021 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Gopalganj Town P.S. Case No. 507 of 2020 for the offence under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
In the instant case total 292 litres of liquor was seized. Learned counsel for the petitioners submits that the petitioner no.1 is business man and petitioner no.2 is staff of petitioner no.1. He further submits that the petitioners have got no criminal antecedent and they are in custody since 02.09.2020.
Considering the fact that the petitioners have got no criminal antecedent, the petitioners, named above, are directed
Patna High Court CR. MISC. No.36541 of 2020(3) dt.05-03-2021 2/2 to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IIcum- Special Judge, Excise Act, Gopalganj in connection with Gopalganj Town P.S. Case No. 507 of 2020.
The petitioners shall deposit Rs.50,000/- (Fifty thousand) cash (each) in the court below and the same shall abide by the final outcome in the trial i.e. if the petitioners are acquitted the amount of Rs.50,000/- shall be refunded in favour of the petitioners, otherwise it shall be forfeited.
