JUSTICE ARUN KUMAR ORAL ORDER 25-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 3.11.2017, seeks bail in Marhowrah PS Case No. 345 of 2017 registered under Sections 341, 324, 307 and 504/34 of the IPC.

The allegation in brief is that the petitioner, son of the informant, was trying to snatch twenty thousand rupees from the possession of his mother, when father of the petitioner came for her rescue then he gave axe blow over his head as a result he succumbed to the injury.

Learned Counsel for the petitioner submits that petitioner is son of the deceased and has falsely been implicated in this case. Whereas learned Counsel for the State submits that there is specific allegation only against the petitioner of giving axe blow over the head and corresponding injury was also found on the person of the deceased as per post mortem report.

Having considered the said facts and circumstances, the prayer for bail of the petitioner is rejected. Snkumar/- (Arun Kumar, J) U T
