Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 147, 341, 323, 324, 302, 504 of the Indian Penal Code. Allegation is that the accused persons including the petitioner assaulted the father of the informant by means of iron rod, lathi, fatta and stick, on account of which he sustained grievous injury and in course of treatment the father of the informant died in the Hospital.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.37089 of 2020(2) dt.02-02-2021 2/2 the petitioner is in custody since 06.06.2020 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Altogether five persons are said to have assaulted the deceased. General and omnibus allegation has been made. No specific injury has been attributed against the petitioner. As per the postmortem report, there is single injury found on the body of the deceased.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st, Bettiah, West Champaran in connection with Bairiya P.S. case No.190 of 2020.
