1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Pasraha P.S. Case no. 71 of 2025 registered under sections 109, 126(2), 115(2), 324(4), 303(2), 329(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3. As per the prosecution case, the informant states that the seven named accused persons came variously armed, surrounded him and started to assault him. It is further stated that one of the named accused namely Bunty Yadav stated that he had been told by the petitioner herein that the dead body of
Patna High Court CR. MISC. No.37869 of 2025(2) dt.12-06-2025 2/3 the informant should not be recovered. The informant states that some of the seven named accused even fired upon him, however somehow the informant managed to escape.
4. Learned counsel for the petitioner submits that the petitioner, who happens to be the full brother of the informant, has been falsely implicated in the case because of pending dispute between the brothers/parties. The petitioner is not named amongst the seven accused who were present at the alleged place of occurrence but has been named by one of the named accused namely Bunty Yadav. No overt act has been alleged against the petitioner who is in custody since 23.4.2025. He undertakes to cooperate in the investigation/trial.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, even as per the allegations levelled therein admittedly the petitioner not being present at the place of occurrence together with the petitioner having remained in custody since 23.4.2025 and the relationship of the informant and the petitioner being of full brothers, the petitioner is directed to be enlarged on bail in connection with Pasraha P.S. Case no. 71 of 2025, on furnishing
Patna High Court CR. MISC. No.37869 of 2025(2) dt.12-06-2025 3/3 bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
