28-11-2016 Heard Sri Krishna Prasad Singh, learned senior counsel assisted by Sri Shailesh Kumar Singh, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.

This is the 2nd attempt for grant of bail. Earlier, by order dated 25-02-2016 passed in Cr. Misc. No. 54162 of 2015, the prayer for bail of the petitioner was rejected mainly on the ground of recovery of Doda weighing 72 Kg., which was of commercial quantity. While rejecting the prayer for bail, this Court had also examined F.S.L. report, which supported the seizure.

Learned counsel for the petitioner submits that petitioner is in custody since 18-06-2015.

Patna High Court Cr.Misc. No.36836 of 2016 (2) dt.28-11-2016 2/2 Keeping in view the fact that on merit, the prayer for bail of petitioner was already rejected, in absence of any change of circumstances, there is no reason to review earlier order. The prayer for bail again stands rejected.
