JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with of Dumra P.S. Case No. 47 2014 registered under Sections406, 420, 120B of the Indian Penal Code. Annexure-2 to this petition reveals that power of attorney was executed in the name of co-accused, Santosh Thakur who happens to be son of the petitioner and the said Santosh Thakur executed sale deed in favour of Ram Bhajan Sah. Therefore, it is apparent that the petitioner is neither holder of power of attorney nor executed any sale deed in respect of lands of the informant.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.11227 of 2015 (2) dt.23-03-2015 well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dumra P.S. Case No. 47 2014 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi subject to the conditions as laid down u/S 438(2) of the Cr. P.C.
