The petitioner seeks bail in connection with Trial No.225 of 2016, arising out of Sahebganj P.S. Case No.203 of 2016, registered under Sections 25(1-b)A, 26(ii) and 35 of the Arms Act. The accusation is of recovery of one loaded country made pistol and one live cartridge from the possession of the petitioner whereas the co-accused Manjay Kumar alias Bantha was also found in possession of one loaded country made pistol and one live cartridge.

Learned counsel appearing on behalf of the petitioner submits that after apprehending by the police in the present case,

Patna High Court Cr.Misc. No.11843 of 2017 (3) dt.28-04-2017 2/2 the petitioner has been remanded in three other cases, as detailed in paragraph-3 to this application, also. Further submission is that the similarly situated co-accused Manjay Kumar alias Bantha has already been granted bail by a coordinate Bench of this Court vide order dated 12.04.2017 passed in Criminal Misc. No.15625 of 2017. The petitioner is in custody since 13.09.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Nayan Kumar, Judicial Magistrate, First Class, Muzaffarpur (West), in connection with Trial No.225 of 2016, arising out of Sahebganj P.S. Case No.

203 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S.
