JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 25(1-B)a,26/35 of the Arms Act. A country made pistol along with cartridge was recovered from the possession of this petitioner. Petitioner is in custody since 23.08.2016.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail, after completion of nine months in custody, on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna/Successor Court, in connection with Danapur P.S. Case No.352 of 2016, with condition that

Patna High Court Cr.Misc. No.9772 of 2017 (3) dt.28-03-2017 petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
