The petitioner seeks bail in Barachatti P.S. Case No. 379/17, registered for the offences punishable under Sections 447, 323, 328, 302, 504 and 34 of the Indian Penal Code and sections 3, 4 of Witchcraft Act.
Allegation against the accused persons including the petitioner is that on 25.06.2017, in the morning, they came at the house of the informant and started abusing. They dragged the husband of the informant out of the house and brutally assaulted him and the informant. The accused persons also gave poison to the husband of the informant It has been submitted that petitioner has been falsely
Patna High Court Cr.Misc. No.13561 of 2018 (9) dt.11-09-2018 2/2 implicated in the case. There is no specific allegation of assault or giving poison to the husband of the informant (deceased) against this petitioner.
The petitioner has no criminal antecedent. He is in custody since 02.11.2017.
Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Barachatti P.S. Case No. 379/17.
