JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 365, 35 and 120B of the Indian Penal Code. Allegation, according to informant, is that his brother was kidnapped by 10 to 12 unknown persons.

It has been submitted on behalf of the petitioner that he is in custody since 30.3.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is not named in the F.I.R. There is no substantive evidence to suggest his implication in the present case. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R. The confessional statement of petitioner before police has led to the recovery of the dead body of the deceased. In his confessional statement he has admitted regarding the crime.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected.
