13-07-2016 Heard Sri Rajendra Narayan, learned senior counsel, who was assisted by Dr. Raj Kumar Singh, learned counsel for the petitioner and Sri Nityanand Tiwary, learned counsel, who has voluntarily appeared on behalf of informant.
This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, prayer for bail of petitioner was rejected on 18-12-2015, vide Cr. Misc. No. 55410 of 2015. The petitioner is in custody since 12-08-2015 on allegation of commission of offence under Section 307 & other allied sections of Indian Penal Code. Keeping in view the nature of accusation and period of custody, let the petitioner namely Rajesh Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri P.K.
Patna High Court Cr.Misc. No.26179 of 2016 (2) dt.13-07-2016 2/2 Ratan, learned Judicial Magistrate 1st Class, Patna City/concerned court in connection with Fatuha P.S. Case No. 219 of 2015 with a condition that one of the bailor must be blood relation of the petitioner and secondly, during trial, the petitioner shall remain physically present on each and every date before the court below. If continuously on two dates, without prior permission of the trial court, he fails to appear before the court below, his bail-bond shall stand automatically cancelled.
