2. The petitioner is apprehending his arrest in connection with Barun P.S. Case No. 199 of 2023, F.I.R. dated 09.05.2023 for the offences punishable under Sections 147, 149, 341, 323, 504, 506, 353, 384 of the Indian Penal Code.

3. As per the First Information Report, police on information that 15-20 vehicles were stopped by the accused persons and they were demanding extortion of money, reached the place of occurrence and saw that six vehicles were parking there with overloading of coal.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the

2/4 present case. The allegation against the petitioner is that he along with other accused are members of Mafia and they flee away from the overloaded coal vehicle from the place of occurrence. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R and similarly situated co-accused persons, namely, Anand Kumar @ Aanand Kumar @ Pandit, Kaushal Kumar @ Golden Kumar, Navlesh Singh, Nawnit Kumar @ Navnit Kumar have been granted the privilege of anticipatory bail by co-ordinate bench of this Court vide order dated 08.08.2023, 04.08.2023, 04.08.2023, 23.05.2024 passed in Cr. Misc No. 42190 of 2023, Cr. Misc. No. 43211 of 2023, Cr. Misc. No. 43623 of 2023 and in Cr.Misc.No.26913 in 2024.

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner. He further submits that the petitioner carries two criminal antecedents other than the present one but fairly submits on the basis of paragraph-3 of the bail application that the petitioner is on bail in the pending matters.

6. Considering the aforesaid facts and circumstances, similarly situated co-accused persons have been granted the

3/4 privilege of anticipatory bail by co-ordinate bench of this Court, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Aurangabad in connection with Barun P.S. Case No. 199 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita and with other following conditions:- i. Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his

4/4 criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
