JUSTICE ARUN KUMAR ORAL ORDER 03-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bihar P.S.Case No. 40 of 2018 registered under Sections 147, 148, 149, 307, 323, 326, 337, 338, 504 and 506 of the Indian penal Code and 27 of Arms Act.

Allegation in brief is that one Karu Paswan was driving his pick-up van and tried to over run one Md. Arshad, due to that altercation took place in between two and from both sides some persons turned up and petitioner also turned up from the side of Karu Paswan alleged to be armed with rifle, Karu Paswan said to have taken the rifle from Shravan Barahi and shot indiscriminately causing injuries to three persons. Submission is that entire allegation is against Karu Paswan and not against this petitioner and he has no criminal antecedent and the injuries found on the persons of injured not

Having considered the aforesaid facts and circumstances, the petitioner, namely, Manish Choudhary @ Manish Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Biharsharif in connection with Bihar P.S. Case No. 40 of 2018.
