Petitioner, in the present case, is wife of an accused in Barhara P.S. Case No. 223/2022 registered for the offence under Sections 147/148/149/307/302/326 of the Indian Penal Code and Section 27 of the Arms Act.

She has prayed for a direction to the respondent authorities to conduct a fair and impartial investigation in the case and submit a report accordingly.

Learned counsel for the petitioner submits that the case is still under investigation. It is stated that the petitioner has submitted a

WJC No.851 of 2022(2) dt.01-11-2022 2/2 representation dated 07.05.2022 to the respondent nos. 2, 4 and 5 wherein she has submitted certain facts which are required to be looked into in course of investigation but despite her representation the respondent authorities are not taking cognizance of the same and are sitting tight over the matter.

Learned counsel for the State submits that the grievance of the petitioner, may be redressed by issuing a direction to the Superintendent of Police, Bhojpur at Ara (respondent no. 4) to look into the representation of the petitioner, examine the same and take an appropriate view thereon.

In the given facts and circumstances, without going into the merit of the case at this stage, this Court directs the respondent no. 4 to look into the grievance of the petitioner as submitted in her representation contained in Annexures P-2, P-2/1, P-2/2 respectively to the writ application and upon consideration take an appropriate view of the matter.

The aforesaid direction is being issued on the statement of learned counsel for the petitioner that investigation is still pending. This writ application is disposed of accordingly.
