2. The petitioner apprehends his arrest in connection with Kateya P.S. Case No. 45 of 2023 registered for the offence punishable under Sections 341, 323, 325, 307, 504 and 34 of the Indian Penal Code.
3. As per prosecution case, on protest by the informant after his daughter getting teased by the petitioner, the petitioner along with other accused persons assaulted the informant and her daughters with iron rod and bamboo piece due to which they sustained injury and blood started oozing out.
4. Learned counsel for the petitioner submits that there is a case and counter case between the parties. They belong to same village. There is no repetition of blow and the
Patna High Court CR. MISC. No.40051 of 2023(2) dt.28-07-2023 2/2 injury of the injured is simple in nature. Petitioner has no criminal antecedent.
5. Learned APP for the State opposed the prayer for anticipatory bail.
6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned C.J.M., Gopalganj in connection with Kateya P.S. Case No. 45 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
