The petitioner is languishing in custody for the offence punishable under Sections 387, 435 and 427/34 of the Indian Penal Code and Section 17 of C.L.A. Act. The report of the Sr. SP / Gaya dated 13.03.2021 reveals that there is chances of early conclusion of the trial as step for procuring attendance of the prosecution witnesses has already been taken.

By order dated 07.09.2020 at Annexure-1, the petitioner was refused prayer for bail by this Court on merit with liberty to renew the prayer after framing of the charges. Considering the information of the Sr. SP/Gaya regarding production of prosecution witnesses, I am not inclined to grant bail to the petitioner for the present in connection with

Patna High Court CR. MISC. No.1875 of 2021(3) dt.17-03-2021 2/2 Sherghatty P.S. Case No. 343 of 2015.

Hence, prayer is refused.

Let Sr. SP/Gaya act in pursuance of his information contained in Letter No. 66/Legal Cell dated 13.03.2021. The learned trial Judge is directed not to allow unnecessary and long adjournment in the case. If no progress takes place in the trial, the petitioner may renew prayer for bail after six months.
