JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2016 Heard learned counsels for the petitioner, Lalit Narayan Mithila University and the State. The petitioner is aggrieved with the notification issued vide memo no.

6131-77/11 dated 29.04.2011 read with memo no. 981-1081 dated 22.01.1998, whereby and whereunder the petitioner's claim for being promoted as professor of Maithili with effect from 01.02.1985 has been rejected.

As prayed for, learned counsel for the petitioner is permitted to withdraw the application to avail the remedy by filing appeal, before the Chancellor of the university, within a period of four weeks.

Patna High Court CWJC No.18940 of 2011 (6) dt.09-12-2016 2/2 Learned counsel for the Lalit Narayan Mithila University submits not to raise the issue of limitation before the Chancellor in view of the fact that petitioner was pursuing his remedy before this Court since the writ application is pending since 2011.

It is expected that the appeal of the petitioner if filed within a period of four weeks, will be disposed of expeditiously in view of the fact petitioner has retired long back.

Accordingly the writ application is disposed of.
