Having regard to the nature of allegation for offence under section 498A of the Indian Penal Code and section 4 of the Dowry Prohibition Act and the petitioner being husband, this Court is not going to rely on his undertaking now being given through his counsel that he is ready to keep his wife, complainant- O.P.No.2, especially when such an effort made by the court below had failed only on account of non-cooperative attitude of the petitioner. Learned counsel for O.P.No.2 in fact also has brought this fact to the notice of this Court that the petitioner while working in Delhi has again married another lady and as such, it will be now difficult for O.P.No.2 to live with the petitioner. In such a situation, this Court is not inclined to grant
